User Terms

These terms apply when you use Barkyard through a dog daycare or boarding business that subscribes to it. That includes families booking care for their dogs, and owners and staff working at the daycare. Barkyard is made by Barkyard Dog LLC ("Barkyard", "we", "us"). By signing in, you agree to these terms. Our Privacy Policy explains how we handle your information.

Your daycare is the business you deal with

Barkyard is the software your daycare uses. It isn't the daycare. Your bookings, prices, deposits, credits, cancellations, refunds, vaccination requirements, trials and the care of your dog are all between you and your daycare. The same is true of any agreement or waiver you sign in the app. Questions or disputes about these go to your daycare. Barkyard doesn't provide dog care and isn't a party to your arrangement with the daycare.

Payments

When you pay in Barkyard, your payment goes to your daycare through Stripe, the daycare's payment processor. Card details are entered into Stripe's secure form and processed under Stripe's terms and privacy policy. Barkyard doesn't receive or hold your money. For refunds or billing questions, contact your daycare.

Your account

• You must be at least 18 to create an account.
• Give accurate information, including your dogs' vaccination records, and keep it up to date.
• You sign in with a link or code sent to your email, so keep your email account secure. Tell your daycare or us if you think someone else has used your account.
• If you add someone else's details, such as an emergency contact or another household member, make sure they're happy for you to share them.

Using Barkyard

Use Barkyard only for its purpose: booking and managing care with your daycare or, for staff, doing your job. Don't:

• upload false records or documents, such as altered vaccination certificates;
• access information you aren't meant to see, or try to get around the app's security;
• upload anything illegal or harmful, or anything that infringes someone else's rights;
• interfere with the service or use automated tools to access it.

Your daycare or we may suspend or remove access if these terms are broken. Your daycare can also remove your access when it no longer works with you.

Your content

You keep ownership of what you upload, such as dog photos and documents. You let your daycare and us store, display and use it as needed to run Barkyard for your daycare. We don't use it for anything else.

Emails

Barkyard sends emails needed to use the service, such as sign-in links, booking reminders, invoices and vaccine reminders, on your daycare's behalf. These aren't marketing emails.

Disclaimers and liability

We work to keep Barkyard accurate and available, but it is provided "as is". We can't promise it will always be uninterrupted or error-free. To the extent the law allows, Barkyard isn't liable for indirect or consequential losses, or for the services your daycare provides. Our total liability to you is limited to $100. Nothing in these terms limits liability that the law doesn't allow to be limited, or rights you have as a consumer that can't be waived.

Changes and ending these terms

We may update these terms. We'll change the date at the top, and for significant changes we'll tell you in the app or by email. These terms stop applying when your account is removed. The sections on liability and governing law still apply after that.

Governing law

These terms are governed by the laws of the State of Maine, without regard to its conflict-of-laws rules, except where the law where you live requires otherwise.
